AB, single and living-in with CD (a married man), is pregnant with her fifth child. She applied for maternity leave but her employer refused the application because she is not married. Who is right? Decide.

The employer is partly correct. AB is not entitled to maternity leave benefits not because she is not married but because maternity leave benefit is payable only for the first four deliveries or miscarriages. However, AB is still entitled to a leave of absence during the period within which she is unfit to work because of her pregnancy.
